Why can I make a claim?

In 2006 The Office of Fair Trading investigated credit card charges and discovered that most fees were disproportionately high. Many lenders were found to be charging customers £35 or more each time they exceeded their limit or made a late payment. This meant that rather than helping a customer having financial difficulties lenders were often making these problems worse. Despite numerous complaints, lenders have attempted to defend card charges claiming they were necessary to cover the administration costs involved in contacting the customer. The majority of letters sent to the customers, though, were automatically computer generated and, even taking into consideration the costs of printing and postage, £35 is clearly very high and very unfair. In addition, many lenders were found to be charging a standard fee regardless of how late a payment was made or how much a limit was exceeded by. So, for example, a customer could be charged £35 for exceeding their credit limit by just £1!

Following their investigation, the Office of Fair Trading made the decision that any fee over £12 was unfair and, as a result, most banks have now lowered their charges below this threshold. Despite these changes, customers can still claim back card charges applied before the reductions and Belmont Thornton can help.

As the charges have been found to be unfair, customers may also apply for additional compensation in the form of interest. This is usually calculated at 8% on several charges, over a number of years, this can be substantial.
